Terms of Use for USA National Boater Exam

These Terms of Use govern your use of USA National Boater Exam on iOS, iPadOS, Android, and any other platform where the app is made available.
1. Acceptance of Terms
By downloading, accessing, or using USA National Boater Exam, you agree to these Terms. If you do not agree, do not use the app. If you use the app on behalf of another person or organization, you confirm that you have authority to accept these Terms for them.
2. Eligibility and Supervision
You are responsible for complying with the laws and rules that apply to you. If you are under the age of legal majority where you live, you should use the app only with permission and supervision from a parent or guardian. A parent or guardian who allows a minor to use the app is responsible for that minor's use.
3. Educational Use Only
The app provides study tools, practice questions, reference material, checklists, and related boating education content. It is designed for exam preparation and general learning only. It is not legal advice, safety certification, official government guidance, or a substitute for instruction from an approved boating safety provider.
USA National Boater Exam is an independent study app. It is not affiliated with, endorsed by, or operated by the U.S. Coast Guard, NASBLA, any state boating agency, any licensing authority, Apple, or Google. Boating laws, equipment rules, age requirements, and exam requirements can vary by state, territory, waterway, and time. Always verify current requirements with the applicable boating authority or approved education provider before operating a vessel.
4. No Guarantee of Exam Results or Certification
We work to keep study content useful and accurate, but we do not guarantee that the app covers every question, rule, local variation, or exam requirement. Your use of the app does not guarantee that you will pass any boating exam or receive any license, boater card, permit, certificate, endorsement, or official exam result.
5. Your Responsibilities
You are responsible for how you use the app, for your study decisions, and for your conduct on the water. You agree not to misuse the app, interfere with its operation, attempt to bypass security or consent flows, attempt to reverse engineer it except where law permits, copy or redistribute app content without permission, or use the app for unlawful purposes.
6. Local Data and Device Requirements
The app may store study progress, settings, accepted legal document status, and related app data on your device. Deleting the app, clearing app data, changing devices, or restoring from backup may affect availability of that data. Some features may require network access, compatible devices, supported operating system versions, app store services, or third-party services.
7. Intellectual Property
The app, including its design, code, text, question sets, explanations, graphics, interface, and other content, is owned by us or our licensors and is protected by copyright, trademark, and other laws. We grant you a limited, personal, non-transferable, revocable license to use the app for your own study and reference purposes in accordance with these Terms.
8. Ads and Third-Party Services
The app may display ads or use third-party services, including Google AdMob, the Google Mobile Ads SDK, and Google's User Messaging Platform (UMP), to support the app, manage consent, measure ads, and provide privacy options. Where required or available, the app may present privacy or consent forms through UMP. On iOS and iPadOS, the app may request App Tracking Transparency (ATT) permission for advertising that tracks activity across other companies' apps or websites.
Third-party services may operate under their own terms and privacy policies. We are not responsible for third-party websites, ads, products, services, content, privacy practices, or availability.
9. Apple App Store and Google Play Terms
These Terms are between you and us, not Apple or Google. Your use of the app must also comply with the Apple Media Services Terms, Google Play Terms of Service, and any applicable app store rules for the platform where you obtained the app.
For Apple platforms, Apple is not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them as they relate to your use of the app on Apple platforms.
For Android and Google Play, Google is not responsible for the app or its content except as required by applicable Google Play terms or law.
10. Updates and Availability
We may update, change, suspend, or discontinue any part of the app at any time. We may also change study content, supported jurisdictions, ad behavior, consent flows, or platform availability. We are not liable for interruptions, data loss, device issues, content changes, or unavailability of the app.
11. Disclaimers
The app is provided as is and as available, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim warranties of accuracy, reliability, completeness, merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
12. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, property damage, exam failure, boating violations, failure to obtain a license or certificate, or other losses arising from or related to your use of the app.
Some jurisdictions do not allow certain disclaimers or limits of liability. In those jurisdictions, the limitations apply only to the fullest extent permitted by law.
13. Changes to These Terms
We may revise these Terms from time to time. The updated version will be posted in the app or made available through app store support materials with a new effective date. Continued use of the app after changes become effective means you accept the updated Terms.
